We are delighted to welcome you to EuroTrip Adventures!  Please take a moment to review the following terms and conditions that outline the agreement between you, our valued traveler, and EuroTrip Adventures Limited and EuroTrip Adventures GmbH, collectively referred to as “ETA,” “we,” or “us.”

1. Tour Operator Details: For trips departing from Germany and meet-us-there trips: EuroTrip Adventures GmbH (ETA GmbH) Am Esper 11, 85101 Lenting, Germany VAT Number: DE323347680. For trips departing from Italy: EuroTrip Adventures Limited (ETA Limited) Company Number 15081472

2. Tax Information: Services provided by ETA are subject to relevant tax regulations. For trips departing from Germany, services are tax-exempt with credit in accordance with German Federal Law, including the Value-Added Tax §§ 4-5, 25. For trips departing from Italy, appropriate tax regulations will apply as per Italian law.

3. Booking Conditions: These Booking Conditions are essential for maintaining the transparency of our agreement with you. They are subject to updates that may occur from time to time. By proceeding with your booking, you agree to these conditions and any future revisions. The most current version can be found at www.eurotripadventures.com/terms-conditions/

4. General Terms and Conditions: In the following sections, “EuroTrip Adventures” or “ETA” refers to the respective entity organizing the trip: ETA GmbH for Germany and meet-us-there departures and ETA Limited for Italy departures.

5. Agreement between Traveler and EuroTrip Adventures: By booking a trip with ETA, you (“User,” “Customer,” or “Traveler”) acknowledge that you have read, understood, and agreed to abide by these terms and conditions. This agreement encompasses all aspects of your travel experience, including but not limited to trip details, payments, cancellations, and responsibilities of both parties.

1     Travel Contract & Payment

1.1  Travel registration shall become binding on receipt of the payment. Registration can only be carried out online. Payment on the phone is not possible. Upon successful payment, the travel contract is concluded. The payment confirmation, which is also the confirmation of participation, will usually be sent from EuroTrip Adventures to the traveller(s) within 48 hours (working days only).

If the content of the travel confirmation diverges from the content of the registration, you will receive a new offer from us. If the traveller agrees to this in written form via email, the travel contract shall take effect on the basis of this new offer. The agreement can be made by explicit or conclusive explanation, such as the written agreement or the payment of the price. Amendments to the trip, such as room changes (e.g. double rooms instead of dormitories), cannot be guaranteed and will depend on the availability of the accommodation. If it is not possible to pay for the upgrade on the website, the traveller(s) may inform EuroTrip Adventures. An email will be sent to the traveller(s) specifying whether or not the upgrade is still available.  If the offer still exists, the extra amount will be paid in cash to the trip leader during the trip itself or via PayPal or bank transfer before the trip. Credit card payment is not possible.

1.2   During the travel period, the scope of contractual services is binding for the terms of reference on www.eurotripadventures.com. Other overnight accommodation and service provider owned brochures or websites are not relevant. The employees of EuroTrip Adventures are not authorized for oral agreements.

1.3  Upon payment of the specified services in the booking confirmation tour price, you accept the general terms and conditions.

1.4  The booking confirmation that you receive with the booking number must be brought on the trip, either printed or electronically from the traveller’s mobile device. In addition, you must bring a valid ID document (national ID document for EU members (for trips within the EU), passport, visa, (Residence permit, blue card etc.) or sofa passport/military ID etc.). Our team members reserve the right to exclude persons from the trip who are without a passport or a national ID (for members of the EU), who do not carry a valid visa in order to cross borders, or who have violated our terms and conditions in any way. If the traveller fails to bring his/her valid and original documents, the travel price will not be refunded.

1.5  All prices are in Euros (€). We are not responsible for any fees, which other banks may charge for currency conversion. For the most up-to-date pricing, please see our website. ETA cannot be held responsible for fluctuations in exchange rates when calculating refunds due to trip cancellations.

1.6  The payment for the ticket online has to be made by the selected payment method (credit card, PayPal or Sofort Überweisung/Klarna). The booking confirmation will be sent to the traveller’s email address latest 48 hours after booking a trip, working days only.

1.7  We do not accept payment in instalments. If instalment payments have been agreed in individual cases, this must be noted in the booking confirmation. Each instalment must be received by a certain date. In violation of that period, it cannot be guaranteed that the traveller’s place is reserved. If the booking is cancelled (by written confirmation of the traveller or by written notification of EuroTrip Adventures), payments which have already been made will be refunded within 7 days according to our terms and conditions. If the violation of the deadline is at the expense of the traveller, a processing fee of 3.50€ will be charged.

1.8  Reservations are accepted based on availability. We reserve the right to decline any booking at our discretion.

1.9  The times of departure, location and further details are always sent three days in advance. In addition, updates for current departure times or notification of unforeseen circumstances such as traffic, weather etc. are always notified by ETA via Facebook (Facebook customer support group). The link to this private Facebook group will be sent out in the info mail at least three days before departure. If the traveller fails to arrive on time to the pick-up location and get on the bus, the travel price paid will not be refunded. If the traveller does not request access to the aforementioned Facebook group, ETA is not held responsible. If the traveller has no access to Facebook, he/she is obliged to inform the ETA team in advance (before the office closes on the last day before the trip starts) and find a solution together so the traveller will get all updates regarding the trip.

1.10   We do not accept VAT forms.

 

2       Rebooking, service changes & price alterations

1.   

2.1  The traveller cannot make following travel amendments: travel date, price, destination, place of departure, accommodation, transportation method. If ETA changes the date of the trip, one of multiple destinations or if the pick-up has been moved to another city, the traveller is free to cancel prior to departure. In this case, the traveller will receive a full refund. The deadline of this decision will be communicated to the traveller via email. The deadline to accept the amendments will be stated in the email. If the traveller does not reply by this deadline, he/she will automatically be refunded the full ticket price.  

2.2  If the traveller has booked a trip which includes bus travel, the customer will find the approximate departure times written in the description on the website. However, the exact departure times will be sent latest 3 days before departure along with the info mail. Travellers are advised not to book train, flight or bus tickets before receiving the final departure times. The times of departure and arrival may change, which will always be communicated before making a reservation on the Facebook event and homepage. The maximum time change may be 5 hours without the traveller having the right to cancel the reservation free of charge. EuroTrip Adventures does not cover any additional costs for missed transport connections before or after the trip if the delay is due to traffic, weather conditions or other unavoidable events that may occur.

2.3  If the traveller does not make use of travel services that have been duly made available to him/her for reasons attributable to him/her, the traveller is not entitled to a full or partial reimbursement of the price.

2.4  If the traveller provides EuroTrip Adventures the wrong contact information and/or email address, we are not responsible for any inconveniences caused by our inability to send the customer the info mail containing meeting points, departure times or any other relevant information of the booked and upcoming trip.

 

3     Withdrawal by the traveller

3.1. The traveller can withdraw at any time prior to departure of the trip. Only written withdrawals to info@chocolate-butterfly-375197.hostingersite.com are binding; a message on WhatsApp, Facebook or other social media means as well as phone calls are not valid. The booking number and name of the passenger must be provided. The date of the email received (German time) will determine how much refund will be granted. We are entitled to claim a reasonable refund for the travel preparations made and for its efforts made. The trip organizer has scaled this compensation claim chronologically; that is, taking into consideration the closeness of the time of withdrawal to the contractually stipulated beginning of the trip (time of departure). Furthermore, it is generalized in a percentage proportion of the travel price considering any normally saved expenses and other uses of travel performance. The refund is calculated according to the time of the receipt of the customer’s notice of withdrawal as follows:

3.2. Day trips from Germany (without accommodation):

Every cancellation more than 30 days before departure will incur a cancellation fee depending on the total cost of the trip paid to EuroTrip Adventures (per person):

Between 0€ – 99€, a 10€ cancellation fee will be applied

Between 100€ – 199€, a 20€ cancellation fee will be applied

Between 200€ – 299€, a 30€ cancellation fee will be applied

This is also valid if you have not received the booking confirmation yet but already made the payment.

Within 30 days before departure, following cancellation fees are valid:

From 30 to 14 days before departure 50% refund

From 13 to 2 days prior to departure 25% refund

From 48 hours before departure 0% refund

This is also valid if you have not received the booking confirmation yet but already made the payment.

3.3. Multiday trips from Germany, coupled with accommodation: (does not apply for meet us there/fly-in trips or trips in combination with a cruise or ferry)

Every cancellation more than 30 days before departure will incur a cancellation fee depending on the total cost of the trip paid to EuroTrip Adventures (per person):

Between 0€ -99€, a 10€ cancellation fee will be applied

Between 100€ -199€, a 20€ cancellation fee will be applied

Between 200€ – 299€, a 30€ cancellation fee will be applied

Between 300€ – 399€, a 40€ cancellation fee will be applied

Between 400€ – 499€, a 50€ cancellation fee will be applied

Between 500€-599€, a 60€ cancellation fee will be applied

600€ and higher will incur a 10% cancellation fee.

This is also valid if you have not received the booking confirmation yet but already made the payment.

Within 30 days before departure, the following cancellation fees are valid:

From 30 to 14 days before departure 50% refund

From 13 to 7 days prior to departure 25% refund

From 6 days before departure 0% refund

This is also valid if you have not received the booking confirmation yet but already made the payment.

3.4. Multiday trips from Germany coupled with ferry transport or a cruise of one or more nights

Every cancellation more than 101 days before departure will incur a cancellation fee depending on the total cost of the trip paid to EuroTrip Adventures (per person):

Between 0-99€, a 20€ cancellation fee will be applied

Between 100-199€, a 35€ cancellation fee will be applied

Between 200-299€, a 50€ cancellation fee will be applied

Between 300-399€, a 65€ cancellation fee will be applied

Between 400-499€, a 80€ cancellation fee will be applied

Between 500€ and higher will incur a 20% cancellation fee.

This is also valid if you have not received the payment confirmation yet but already made the transfer.

Within 100 days before departure, the following cancellation fees are valid:

From 100 to 71 days before departure 250€ canclation fee.

From 70 to 33 days prior to departure 60% Cancelation fee.

From 32 days before departure 5% refund.

This is also valid if you have not received the booking confirmation yet but already made the payment.

 

3.5 Fly-in & Meet Us There Tours

Every cancellation more than 45 days before departure will incur a cancellation fee depending on the total cost of the trip paid to EuroTrip Adventures (per person):

Between 0€ -99€, a 10€ cancellation fee will be applied

Between 100€ -199€, a 20€ cancellation fee will be applied

Between 200€ – 299€, a 30€ cancellation fee will be applied

Between 300€ – 399€, a 40€ cancellation fee will be applied

Between 400€ – 499€, a 50€ cancellation fee will be applied

Between 500€-599€, a 60€ cancellation fee will be applied

600€ and higher will incur a 10% cancellation fee.

This is also valid if you have not received the booking confirmation yet but already made the payment.

Within 45 days before departure, the following cancellation fees are valid:

From 45 to 30 days before departure 50% refund

From 30 to 14 days prior to departure 25% refund

From 14 days before departure 0% refund

This is also valid if you have not received the booking confirmation yet but already made the payment.

 

3.6 Multiday trips coupled with flights

For multi-day trips that include flights, €300 of the total amount paid is non-refundable and will be retained as the cost of the flight.

The remaining balance of the canceled trip will be refunded based on the following conditions:

Cancellations Made More Than 45 Days Before Departure

A cancellation fee will be applied based on the total amount paid per person to EuroTrip Adventures (excluding the €300 flight cost):

  • €500–€599: €60 cancellation fee

  • €600–€699: €70 cancellation fee

  • €700 or more: 10% cancellation fee

Cancellations Within 45 Days of Departure

  • 45 to 30 days before departure: 50% refund of the total trip cost

  • 30 to 14 days before departure: 25% refund

  • Less than 14 days before departure: No refund

 

This is also valid if you have not received the booking confirmation yet but already made the payment.

Within 45 days before departure, the following cancellation fees are valid:

From 45 to 30 days before departure 50% refund

From 30 to 14 days prior to departure 25% refund

From 14 days before departure 0% refund

This is also valid if you have not received the booking confirmation yet but already made the payment.

 

3.7 Until the start of the journey, the traveller can replace themselves with any other suitable traveller. Prior to the departure time of the first/earliest pickup, the traveller will need to email the changes to EuroTrip Adventures up to 36 hours for day trips, 48 hours for multiple day trips, 5 days (120 hours) for trips involving a cruise and 4 weeks involving a flight. EuroTrip Adventures is entitled to demand a processing fee of 5€ per person for a day trip, 15€ for a trip with accommodation, and 20€ for a trip involving a cruise or a flight. The aforementioned processing fees also apply if the name, the passport number, date of birth or any other important information of the traveller needs to be corrected for reasons which fall within the responsibility of the travellers. The processing fee can be paid with bank transfer, PayPal or in cash at the meeting point.

3.8. Change of pickup location by the traveller: if the traveller wants to change the pickup location to a different pick-up from the one he/she has booked, the traveller has to send an e-mail to info@chocolate-butterfly-375197.hostingersite.com with the request, and due to availability, pay 5€ administration fee / 10€ administration fee if a public transport (e.g. Flixbus) is involved. Additionally, the difference in price of the pickup locations has to be paid via PayPal or cash on the bus if it occurs. If the price of the new location is lower, the traveller still needs to pay the administration fee of 5€ (or 10€). The difference in price will not be refunded.

3.9 Passenger lists will be finalized 36 hours before departure for one-day trips, 48 hours for overnight-trips and 5 days for cruises, which means no changes can therefore be made after this time.

3.10 Costs incurred by the traveller such as like visa, telephone or handling fees are non-refundable upon on cancellation of a trip.

3.11 Tickets and vouchers obtained through a sweepstake are not cashable and non-refundable.

3.12 For any bus seat reservations, only 1 seat is possible to book online per person. If you book 2 or more seats for 1 person, you will not be refunded, as the this amount will be taken as an admin fee and you will still only have 1 seat.

 

4       Optional tours, upgrades or services

4.1 For some trips, there is the possibility to join an optional tour (“Optional extra”). Travellers, who sign up for an optional extra activity, online or before the due date for the sign up communicated in the info mail, have priority (due to availability). If there are still places available for last minute sign-ups, the EuroTrip Adventures team will make an announcement on the bus. If the traveller signs up for an optional extra activity, the same cancellation conditions stated in 3.2 will apply.

4.2 Unless otherwise stated, the optional tours that are not included in the tour price and/or have not been purchased online are paid on the day of the tour in cash in euros (€). We do not accept card payments on the bus.

4.3 It is the responsibility of the traveller to be on time and with everything required to take part in an optional tour. If the traveller fails to be on time at the indicated meeting point, he/she is not entitled to a refund. ETA or the tour operator booked via ETA cannot be held responsible if the traveller loses the group during the tour. A refund will not be issued.

4.4 The traveller is not entitled to reimbursement of lost or stolen tickets or coupons.

4.5 EuroTrip Adventures reserves the right to increase the price of an optional activity to that of the price stated online. If the optional tour differs significantly from what was stated online and the reasons are within ETA’s power, the customer is able to receive a full refund before the tour takes place. The customer cannot receive a refund if the tour has to be changed for reasons outside of ETA’s power (weather, traffic etc.).

4.6. In terms of accommodation, an upgraded room (private room of 2, 3 or 4 beds, deluxe or superior rooms, single rooms, family rooms etc.) can be cancelled by the traveller up until 9 days before departure based upon availability of other beds/accommodation arrangements. The refunded amount will be 50% of the supplement for the upgraded room. A cancellation of less than 9 days is not possible. If a traveller cancels an upgraded room, he/she will automatically be accommodated in a shared room (included in the basic ticket).

4.7 Seat Reservations: The traveller will have the option to reserve their seat on the bus online around 3-4 days before departure. The link for the online reservation will be sent out in our info mail. If the traveller does not reserve a seat online, our system will automatically allocate seats that haven’t been booked. It is possible that travellers, who booked their tickets together, will not be seated next to each other or near each other. Families with children under 18 can sit in the “Family Zone” without extra charge which is situated in the last rows of the top deck or in the last rows of the bus if it is not a double decker. It is not possible to book a seat within the family zone. ETA will allocate each family together in the family section (1, maximum 2 adults close to a child (17 or younger; other passengers on the same ticket might sit somewhere else). If the travellers wish to sit somewhere else, they can book their seats outside the family area. ETA does not accept seat requests without prior booking.

 

5     Cancellation of contract by EuroTrip Adventures

5.1 If the minimum number of participants has not been reached, EuroTrip Adventures is entitled to cancel the trip up to two days prior to departure for one day trips without accommodation, four days prior to departure for multiple day trips with accommodation and 14 days prior to departure for cruise trips. Any ticket which has already been paid will be refunded in this case without delay and without handling charges. Additional costs incurred, such as shuttle transport, flight tickets, visa or additional nights cannot be laid at our expense.

5.2 ETA reserves the right to cancel pick-ups if the minimum amount of registrations has not been reached. Typically, the minimum number is 5-10; however, this depends on the city in question and also the trip. In this case, the traveller either receives a full refund or can choose a different pick-up. If the new pick-up is more expensive than the previous one, the traveller does not have to pay the difference (depending on availability). If the new pick-up is less expensive than the previous one, the traveller will receive the difference back.

5.3 EuroTrip Adventures is entitled to withdraw from the contract without notice if the traveller significantly disturbs the trip (e.g. harassing fellow travellers or our trip leader(s), disobeying the requests of the trip leader(s), or if he/she behaves in violation of the contract). If the traveller is removed from the trip, EuroTrip Adventures reserves the right to the travel price and no compensation will be issued to the traveller. Any expenses the traveller has due to this will not be paid by ETA.

5.4 If the cancellation of the trip is due to force majeure (i.e. circumstances like political unrest, war or threat of war, riots, civil strife, industrial disputes, terrorist activity, natural and nuclear disasters, fire, epidemic or health risk, adverse weather conditions or other similar events beyond EuroTrip Adventure’s control), we will provide a refund of the ticket cost, however, ETA keeps the right to keep a small part of the ticket payment in order to cover costs incurred in respect of your booking. The exact amount will be determined individually depending on the trip and the circumstances. EuroTrip Adventures is not responsible for the cost of any other travel arrangements affected due to cancellation or the rescheduling of any trip. This only applies if the whole trip is cancelled.

5.5 For meet-us-there and Germany departures – If a trip cannot be carried out due to insolvency of the tour operator, the tour price is insured with R+V insurance in accordance with 651 k of the German Civil Code (BGB). 6      Travelling with children under the age of 18

6.1 Every event on our website and Facebook event states the minimum age in which to join a trip. Trips that are excluded for children are marked with 18+ in the description. Trips that are excluded for children younger than two are marked with 2+ in the description. Parents/Guardians are required to read the description and estimated times of departure and arrival in order to estimate if the trip is suitable for their child.

6.2 Child/infant fare may be available and varies by trip. Some activities within a trip may have weight/height restrictions and/or different minimum ages than our overall minimum eligibility age or recommended minimum age.

6.3 ETA cannot provide child-care items (such as, but not limited to, car seats, strollers, babysitters, day care etc).

6.4. Travellers with children under 18 years old are required to upgrade and/or book a private room unless they know another traveller on the same trip that they can share the accommodation with. This must be communicated beforehand via email. If the family fills every bed of a hostel room, hotel room or cabin, no upgrade is required, depending on availability and the house rules of the hostel. If the traveller with the child refuses to upgrade, ETA has the right to cancel the reservation according to the cancelation policy in point 3.

6.5 If the traveller has booked a trip with a connection (i.e. A traveller has booked from Frankfurt but requires a Flixbus from Frankfurt to Nuremberg) and has booked a ticket for a child aged under 3, he/she must bring their own booster seat in order to enter the Flixbus bus. A booster seat is not necessary for the EuroTrip Adventures bus.

6.6 Passengers under 18 are not able to join without their legal guardian(s). Written consent form provided by the legal guardians is not accepted.

7       Accommodation

ETA tries its best to allocate the rooms according to every traveller’s wishes. However, as this might not always be possible, the traveller is not entitled to a refund if his/her wishes cannot be met. In general, room allocation involves sharing with mixed genders, mixed nationalities and mixed ages.

8      Passport and Visa Regulations

8.1 It is the responsibility of the traveller to bring the original travel documents he/she needs in order to travel to the booked destination, including all the countries that might be necessary to cross to get there. Copies are not accepted. EuroTrip Adventures is not responsible for any delays or denial of boarding our bus, cruise or any other means of transportation due to failing to provide these documents. Our trip leader reserves the right to exclude anyone from the trip who does not carry a valid passport or national ID (for members of the EU for trips within the EU), and – if necessary –  a valid visa in order to cross borders, or who has violated in any way these stated terms and conditions. If the traveller fails to bring his/her valid and original documents, the travel price will not be refunded.

8.2 We are not liable for timely issue and delivery of required visas by the diplomatic representatives in question. In case of any delays in issuing the required visa, the traveller will not receive a full refund and the cancellation policy in point 3 of his/her ticket applies.

8.3 If the traveller’s passport and/or visa is stolen or lost during a trip, he/she is obligated to let the trip leader know immediately. The traveller will not be able to board the bus without documents which means, he/she will not be taken back to Germany and/or the next destination if this involves crossing borders. The traveller is not entitled to a partial or full refund. ETA will not cover any costs to replace stolen/lost documents or transportation back to Germany.

8.4 Travel requirements for US Military Members: ETA enforce the requirement to possess a tourist passport for all trips. Should you come to the departure point and present the incorrect passport, you will be turned away with no refund, per our cancellation policy. Important passport rules are as follows:

– If you have a passport with a SOFA stamp on any page (a “No-Fee passport), you are provided permission to reside in Germany, NOT to travel outside of Germany. You have to have a tourist passport in addition to the SOFA/”No-Fee” passport to travel outside of Germany.

– You cannot travel with a RED Official passport as that is used only for the purpose of a mission or deployment. If you have a passport with a detachable SOFA card clipped inside, it is acceptable to travel with as that was issued originally as a tourist passport. If you are not sure: a tourist passport will be BLUE and will be valid for 10 years for adults. It cannot contain a SOFA stamp on any page or it is not acceptable. A child’s tourist passport (under 15 years of age) is valid for 5 years, but will not have a SOFA stamp in it anywhere. All of this information has been verified to be correct with the Grafenwoehr Passport Office. Should you have any questions, please contact them as we do not handle passport issues.

ETA recommends that you apply for any necessary visas with a visa service. For more information on countries requiring visas for U.S. citizens, please refer to the U.S. Department of State website: travel.state.gov.

9       Baggage Allowance

Luggage should be able to be stored below the bus by each person themselves and the personal item should contain whatever you might need on the bus. Pillows and blankets do not count for the personal item. If you have additional items such as strollers, etc. please send us a message to info@chocolate-butterfly-375197.hostingersite.com in order to make those arrangements. The baggage allowance is not valid for the Baltic Cruise. Each adult is entitled to the following baggage allowance:

Adults may take:

Day Trip:

  • a rucksack / backpack to take on the bus with you + stroller if you have small children

Trip 1 and 2 overnight stays:

  • a rucksack/backpack to take on the bus with you
  • a small suitcase of max. 10kg (22lbs)
  • stroller if you have small children

Trip with 3 or more overnight stays:

  • a rucksack/backpack to take on the bus with you
  • a small suitcase of max. 15kg (33lbs)
  • stroller if you have small children

Children (2 -11 years old) may take:

Day Trip:

  • a rucksack / backpack to take on the bus with you

Trip 1 and 2 overnight stays:

  • a rucksack/backpack to take on the bus with you
  • a small suitcase of max. 5kg (11lbs)

Trip with 3 or more overnight stays

  • a rucksack/backpack to take on the bus with you
  • a small suitcase of max. 10kg (22lbs)

At boarding, for every kg / 2lbs of overweight luggage, we charge 5€ to be paid in cash.

Children from 12 and older have the same allowance as adults

Charges per additional weight (pre-booked):

1kg – 5kg / 2lbs – 11lbs : 10€

6kg – 10kg / 13lbs – 22lbs: 20€

10     Liability

10.1 The organizer is not liable for disturbances to services, personal and material damages in association with services which are outside the totality of the performance owed by EuroTrip Adventures and are therefore additional services [for example, travel by scheduled public transport] represent third party services for whose flawless performance in conformity with the contract EuroTrip Adventures cannot accept liability.

10.2 Each traveller is responsible for his or her timely arrival to the departure of the transport to or from the destination itself, unless their late arrival is the result of an intentional or grossly negligent action on the part of EuroTrip Adventures. EuroTrip Adventures cannot be held liable for any delays or failure to get to the excursion destination when the reason for this is not influenced by the team members of EuroTrip Adventures. This includes changes in the weather, strikes, border control, other political situations, technical failures, congestion, poor road conditions or other reasons that are out of our control. 

 

11     People Responsibility

11.1 With payment of the trip, the traveller agrees to recognize the team members during the period of travel as an authority figure and to obey the laws of the country visited, including customs restrictions and currency exchange. In violation of laws of the country or instructions of the staff of EuroTrip Adventures, the traveller will be excluded from the trip with immediate effect. Incidental costs incurred for return travel or the like shall be borne by the traveller. The refund or partial refund of the tour price is excluded.

11.2 The trip leader may make decisions outside the agreed travel itinerary in favour of the security/wellbeing of the passengers or in the best interest of the travel group. The traveller agrees to comply with this decision.

11.3 Each traveller is responsible to arrive to the arranged meeting place and to appear during the trip. If the traveller is late to the meeting time, the bus will leave at the scheduled time of departure. Any costs incurred will be borne by the traveller.

11.4 Each traveller assigns at the time of travel his/her image and video rights to EuroTrip Adventures and/or our third party digital media companies working on behalf of EuroTrip Adventures. We are permitted to take photos and create videos featuring all those participating in the trip. These may be published on our website and social media website, as well as in flyers or brochures. If this is not wished by the traveller, it is his/her own responsibility to keep away from cameras and video equipment.

11.5 The team members are always approachable and will help in all situations where possible, however, they are not a permanent care for the travellers. It is assumed that every traveller can move freely and walk alone through cities or longer parts of the route without additional assistance of one of our team members. We cannot provide any assistance to individuals with physical disabilities. Furthermore, the coaches are not designed to transport wheelchairs. In this case, the traveller is advised to contact us to see if it is possible to attend a specific trip.

11.6 Our trip leaders are not professional tour guides and not responsible for conveying historical facts, conducting tours or anything similar.

11.7 Our team members will be the main point of contact for the traveller throughout the tour. The traveller will have access to our online Facebook group in order to stay updated with news and where he/she is able to contact their trip leader(s). The traveller may also contact the trip leader on their Facebook account. Additionally, the trip leader posts their contact phone number in the Facebook group in case of emergency and can be reached at any time. The trip leader is available during the trip, not after the trip or the days before the trip takes place. For any questions, the traveller may contact the office phone during the office hours.

11.8 EuroTrip Adventures does not offer any kind of travel insurance. Any suitable medical insurance or travel insurance is the traveller’s responsibility.

12    Handling of complains, terms of preclusion for claims and expiry

12.1 The traveller can assert to us towards claims within one month after the end of the trip. It is recommended to write the claims in writing. After the deadline, claims can only be invoked if the traveller was prevented from complying with no fault of his/her own.

12.2 The Parties agree to a limitation period of six months for contractual claims with the exception of blameworthy injury of life, body or health claims. Neither can the organizer, its legal representatives, vicarious agents, or intentional or grossly negligent breaches of duty be accused. For these cases, the statutory limitation period of two years in accordance with § 651g para 2 applies BGB. The period begins on the day following the contractually stipulated date of the end of the trip. Tort claims are limited to three years.

13     Legal Responsiblities

ETA makes every effort to ensure the accuracy of its publications, but it cannot be held responsible for typographical or printing errors, including but not limited to prices. ETA trips are not for resale, and travellers must enrol directly with ETA.

14     Other privisions and agreements

14.1 These terms and conditions apply unless individual agreements are made in the individual travel contracts. This has to be done in written form.

14.2 The data provided to us is to be electronically processed, stored and distributed as part of the purpose of the contract. Personal data is protected according to the Federal Data Protection Act.

14.3 Obvious pressure and miscalculations (e.g. technical errors on the website, wrong uses of Early Bird codes) entitle the organizer to contest the travel contract.

14.4 The above provisions shall only be valid if and insofar as after the publication of statutory provisions come into force no other provisions to the contrary.

14.5 The ineffectiveness of individual provisions does not invalidate the entire travel contract. The application of German law is agreed. The contract language is English.

Please note: The traveller is to provide us with all information and present all documents required for the determination of the obligation to provide benefits. In accordance with § 651k (1) Nr. 2 BGB, costs necessarily incurred shall be paid by the traveller and he/she is to avoid everything that could lead to inappropriate increase in costs.

14.6 EuroTrip Adventures is bonded by a mandatory German Guarantee Foundation. This guarantees the amount that you paid in booking your trip as well as your repatriation in the event of insolvency/bankruptcy by EuroTrip Adventures. On the website www.tip.de/register/ you can check that EuroTrip Adventures is registered.

14.7 Every traveller is obliged to understand the content of the Terms and Conditions or it must be translated into his/her language. With payment of the travel price, EuroTrip Adventures assumes that the Terms and Conditions have been translated and understood.

15     COVID-19 Regulations

15.1 The traveler must wear a proper face mask or protective nose and mouth cover (can be self-made) during boarding and bus journey. Children under 6 years old are not required to wear a mask.

15.2 We will plan more breaks because the toilet must be closed due to current regulations.
 
15.3  Social distancing of 5 feet or 1,5 meters while entering or exiting the bus.
 
15.4  Your trip leader will provide you with liquid disinfection to clean your hands before entering the bus.

16     Release & Agreement

16.1. I, on behalf of myself and/or my minor child (if applicable), understand that my trip begins with the leave from the departure point / departure airport and ends upon completion of the return bus ride / cruise trip. It is my own responsibility to reach all meeting points of the trip on time and I understand that if I do not, I cannot claim any refund or partial refund. I further understand that travel involves certain risks to personal health, safety and property. Many foreign countries do not have the safety and health standards that are present in Germany or my home country. I am willing to accept the associated risks of travel and understand that ETA cannot guarantee the health and safety of participants.

16.2. I agree to release and hold harmless ETA from and agree not to sue ETA for any and all claims, of any nature related in any manner to my participation in an ETA-sponsored tour, including but not limited to, claims for negligence, breach of contract, breach of express or implied warranties, or wrongful death. I hereby unconditionally and unequivocally waive any and all claims and demands for all damages, losses, costs and expenses of any nature whatsoever (including attorneys’ fees) on account of or arising out of any and all personal injury, death, bodily injury, mental anguish, emotional distress, property or other damage that I may suffer from any cause whatsoever related in any way to my participation in any ETA- sponsored tour. I further agree to release and hold harmless ETA from any and all decisions to cancel, modify or delay the tour as a result of Acts of God like war (whether declared or undeclared), terrorist activities or threats of terrorists activities, instability in a destination country, incidents of violence, public health issues or quarantine or threats of public health issues, substantial currency fluctuations, strikes, government restrictions, fire or severe weather conditions that make it impossible or commercially unreasonable in the sole opinion of ETA to conduct the tour. I further agree to hold ETA harmless for the acts or omissions of any other individuals or entities over which ETA have no direct or indirect control, including, without limitation, airlines, railways, bus companies, hotels, shipping companies, tour guides and subcontracted agents or tour operators. 

16.3. I understand and agree that ETA shall have no liability or responsibility for me when I am absent from ETA-supervised activities or for non-ETA supervised activities, such as visits to friends or relatives or during pre-/post-stay periods if the pre-/post-stay period does not include the services of ETA.

16.4. I understand and agree that ETA reserves the right to refuse or cancel my reservation at their sole discretion.

16.5. I agree to abide by ETA’s regulations and the directions of my Trip Leader and ETA’s personnel during my trip. Failure to do so may result in ETA terminating me from the trip immediately. I understand that to disobey such rules or directions is to waive the right to a refund of any part of the fee, and that ETA may then send me home at my own expense.

16.6. I agree to abide by all local laws when abroad. I also understand that, should local authorities be involved, I will be subject to the laws of the country I am visiting.

16.7. I understand and agree that if I become ill or incapacitated, ETA and its employees may take any action they deem necessary for my safety and well-being, including securing medical treatment (at my own expense) and transporting me home (at my own expense). ETA retains the right and has my authorization, in its sole discretion, to contact my emergency contact(s) with regard to health issues or any matter whatsoever that relates to my tour. In the event of a medical emergency, ETA will attempt to cause appropriate treatment to be administered, and I authorize ETA to do so. ETA, however, makes no warranty that it will be able to cause effective (or any) emergency treatment to be administered.

16.8 I understand and agree that ETA has the right to make changes in tour itineraries and departure dates, and to modify transportation arrangements, including the use of substitute airlines. In the event of such changes, refunds will be given only in accordance with the provisions of the Booking Conditions supplied herewith.

16.9 I understand that prices are subject to unforeseen surcharges or price increases which, if imposed by tour operators or other suppliers will be separately billed prior to final payment date.

16.10 I understand that it is my responsibility to secure the necessary travel documents (passport and/or visa[s]). Failure to do so does not constitute grounds for a refund except according to the refund and cancellation guidelines as outlined in the Booking Conditions.

16.11. I understand that I will be required to pay for any phone calls or incidental personal expenses that I incur at hotels, as well as for any damage I cause to hotel rooms, buses or other property.

16.12 I understand and agree that this agreement and ETA’s Booking Conditions constitute the entire agreement between ETA and me with reference to the subject matter herein, and I do not rely upon any promises, inducements or agreements not herein, including but not limited to any oral statements made to me by any agents or employees of ETA. 

16.13 I understand and agree that this agreement shall be governed in all respects, and performance hereunder shall be judged, by the laws of the courthouse of Ingolstadt (Landgericht Ingolstadt, Germany) for trips departing from Germany and meet-us-there trips, and by the laws of the courthouse of Fareham Magistrates Court (United Kingdom) for trips departing from Italy. In the event of any claim, dispute, or proceeding arising out of my relationship with ETA, or any claim which in contract, tort, or otherwise at law or in equity arises between me and ETA, whether or not related to this agreement, all parties submit and consent to the exclusive jurisdiction and venue of the county courthouse of Ingolstadt (Landgericht Ingolstadt, Germany) for trips departing from Germany and meet-us-there trips, and the exclusive jurisdiction and venue of Fareham Magistrates Court (United Kingdom) for trips departing from Italy.

16.14 I understand and consent that ETA and their third parties may use any film likenesses taken of me and any of my comments while on an ETA tour for future publicity and also use my contact information for future ETA promotions.
